iDemand Driver and DealerDrive Program Terms and Conditions
1. Acceptance of Terms:
By participating in the iDemand Driver or DealerDrive program, you agree to comply with and be bound by the terms and conditions outlined herein. These terms constitute a legally binding agreement between you and iDemand Driver Inc.
2. Eligibility:
To be eligible for participation in the Program, you must meet the criteria outlined by the Company. The Company reserves the right to modify eligibility requirements at its discretion.
3. Program Description:
The Program encompasses the iDemand Driver and DealerDrive initiatives, providing a platform for drivers and dealerships to connect, access services, and benefit from mutual collaborations.
4. User Responsibilities:
a. Users are responsible for providing accurate and up-to-date information during the registration process. b. Users must adhere to all applicable laws and regulations while participating in the Program. c. Users are expected to maintain the security of their account credentials and promptly report any unauthorized access.
5. Program Modifications:
The Company reserves the right to modify, suspend, or terminate the Program at any time without prior notice. Such modifications may include changes to eligibility criteria, pricing structures, or any other program elements.
6. Data and Privacy:
a. Users consent to the collection and use of personal data in accordance with the Company's privacy policy. b. The Company may use aggregated and anonymized data for analytics, research, and improvement of services.
7. Fees and Payments:
a. Users agree to pay any applicable fees associated with their participation in the Program. b. The Company may modify fee structures with reasonable notice.
8. Termination:
a. The Company reserves the right to terminate a user's participation in the Program for violations of these terms or any applicable laws. b. Users may terminate their participation at any time by following the provided procedures.
9. Intellectual Property:
a. Users retain ownership of their intellectual property. b. Users grant the Company a non-exclusive, royalty-free license to use content submitted to or through the Program.
10. Limitation of Liability:
The Company IDEMAND DRIVER INC. is not liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Program.
11. Governing Law:
These terms and conditions are governed by and construed in accordance with the laws of Newark DE. Any disputes arising from these terms shall be resolved through arbitration in Newark, DE in accordance with the rules of the American Arbitration Association.
